Welcome to The Mobile Essential. These Terms of Service govern your access to and use of our website, themobileessential.com, and your purchase of products from us. By accessing our website, placing an order, or using our services, you acknowledge that you have read, understood, and agreed to these Terms of Service.

1. Account Terms

You may be required to provide certain information when placing an order or creating an account. You agree to provide information that is accurate, complete, and current and to update it when necessary.

You are responsible for maintaining the confidentiality of any account credentials or information associated with your account. You are also responsible for activities carried out through your account.

The Mobile Essential reserves the right to refuse service, cancel accounts, restrict access, or cancel orders where we reasonably believe there has been fraudulent, unlawful, abusive, misleading, or unauthorized activity or a violation of these Terms.

2. Pricing and Payment

All prices displayed on themobileessential.com are generally stated in Pakistani Rupees (PKR), unless otherwise specified. Prices, promotions, discounts, product availability, and other commercial information may change without prior notice.

We make reasonable efforts to display accurate pricing. However, in the event of an obvious pricing, product, or listing error, we reserve the right to correct the information and, where appropriate, cancel or modify an affected order.

We may offer Cash on Delivery (COD) and other payment methods that may become available through the website. For COD orders, the applicable amount is payable to the courier upon delivery.

For COD orders delivered through M&P (Muller & Phipps), M&P may collect the payment from the customer and subsequently settle or remit the collected amount to The Mobile Essential according to the applicable merchant arrangement between The Mobile Essential and M&P.

Payment collection, settlement timing, banking processes, and related financial processing may depend on the relevant payment, courier, or banking service provider.

3. Product Descriptions

We make reasonable efforts to ensure that product names, descriptions, specifications, images, prices, and other information displayed on our website are accurate and useful.

However, product appearance, colour, packaging, branding, specifications, accessories, or other details may vary due to manufacturer changes, updated packaging, production variations, photography, lighting, or differences in individual device screens.

A product may also be supplied in packaging that differs from images shown on the website where the underlying product remains materially consistent with the listing.

4. Order Placement and Acceptance

Placing an order through our website constitutes a request to purchase the selected product or products. Submission of an order does not necessarily mean that the order has been finally accepted.

Orders may be reviewed, verified, processed, accepted, delayed, restricted, or cancelled at our discretion where reasonably necessary, including situations involving stock availability, pricing or listing errors, incorrect customer information, suspected fraud, unusual ordering activity, repeated delivery failures, unavailable delivery locations, or other operational reasons.

For COD orders, we may contact you through phone, WhatsApp, SMS, or other available communication methods to verify the order before dispatch.

If an order cannot be reasonably verified or appears fraudulent, misleading, duplicated, abusive, or otherwise irregular, we may cancel or decline the order.

5. Shipping and Delivery

We currently deliver within Pakistan through available courier services, including M&P, subject to service coverage and operational availability.

Orders are generally processed within 1–2 business days, with business days being Monday through Saturday, excluding applicable holidays or circumstances that prevent normal operations.

Estimated delivery is generally 2–5 business days after dispatch. Delivery to remote areas, areas with limited courier coverage, or locations experiencing operational delays may take longer.

Delivery estimates are provided for general guidance and are not guaranteed delivery dates.

Customers are responsible for providing a complete and accurate delivery address, recipient name, and active contact number. Incorrect, incomplete, inaccessible, or unverifiable delivery information may result in delivery delays, additional attempts, return of the parcel, or order cancellation.

Once an order has been handed over to the courier, delivery scheduling, routing, tracking, attempted delivery, delays, and other courier operations are handled by the relevant courier provider.

6. Cash on Delivery

For COD orders, the customer is responsible for paying the full amount shown as payable at the time of delivery.

Customers should verify the payable amount and order details before completing payment.

Repeated refusal of legitimate COD orders, providing false information, intentionally placing fraudulent orders, misuse of COD, or repeated failure to accept parcels may result in cancellation of future orders, restriction of COD availability, or other reasonable account or order restrictions.

7. Returns and Refunds

Returns and refunds are subject to our applicable Return & Refund Policy.

Customers should inspect their order as soon as reasonably possible after receiving it. If a product arrives damaged, defective, incorrect, or materially different from the product ordered, the customer should contact us within 7 days of delivery.

When requesting a return, replacement, or refund, we may require the order number and reasonable supporting information, including photographs, videos, packaging details, or other evidence necessary to assess the request.

Products may be subject to return conditions and exclusions. Depending on the product and circumstances, these may include damage caused after delivery, misuse, improper installation, unauthorized modification, missing accessories or packaging, signs of use, hygiene-related concerns, change-of-mind requests, or other conditions specified in our Return & Refund Policy.

Approval of a return, replacement, or refund is subject to the applicable policy and assessment of the circumstances.

Where a refund is approved, the applicable refund method and processing time may depend on the payment method, courier process, banking system, and other relevant circumstances.

8. Prohibited Uses

You agree not to use our website or services for unlawful, fraudulent, abusive, misleading, or unauthorized purposes.

You must not attempt to interfere with the operation or security of the website, gain unauthorized access to accounts or systems, introduce malicious code, conduct unauthorized scraping or automated activity, impersonate another person or business, manipulate promotions, place fraudulent orders, abuse refund or return processes, or misuse our intellectual property.

We may restrict or terminate access to our website or services where we reasonably believe prohibited activity has occurred.

9. Intellectual Property

Unless otherwise stated, content appearing on themobileessential.com, including our brand name, logo, graphics, photographs, product descriptions, written content, website design, layout, and other materials, may be owned by or licensed to The Mobile Essential and may be protected by applicable intellectual property laws.

Purchasing a product from The Mobile Essential does not transfer ownership of our trademarks, website content, photographs, graphics, or other intellectual property.

Our website and business operations may depend on third-party services and providers, including Shopify, M&P, payment providers, banks, telecommunications providers, advertising platforms, analytics services, hosting providers, social media platforms, technology providers, and other service providers.

These third parties may operate under their own terms, policies, systems, procedures, and privacy practices. The Mobile Essential does not control the independent operations, policies, availability, security, systems, or performance of third-party providers.

To the maximum extent permitted by applicable law, The Mobile Essential is not responsible for independent acts, omissions, failures, interruptions, delays, security incidents, technical problems, data handling, service availability, or other matters arising from third-party services that are outside our reasonable control.

11. Limitation of Liability

To the maximum extent permitted by applicable law, The Mobile Essential shall not be responsible for indirect, incidental, special, consequential, exemplary, or other losses arising from or related to the use of our website, purchase of products, delivery services, courier delays, third-party services, website interruptions, technical failures, unauthorized access, communications failures, or circumstances outside our reasonable control.

We do not guarantee that the website will always be available, uninterrupted, error-free, completely secure, or free from technical problems. We also do not guarantee that every product will remain continuously available or that estimated delivery times will always be achieved.

To the maximum extent permitted by applicable law, The Mobile Essential is not responsible for delays, interruptions, or failures resulting from circumstances beyond our reasonable control, including natural disasters, severe weather, strikes, government restrictions, public disturbances, internet or telecommunications failures, courier disruptions, supplier issues, technical outages, or other similar events.

Nothing in these Terms is intended to exclude or restrict any liability or consumer right that cannot legally be excluded or restricted under applicable law.

12. Events Beyond Our Reasonable Control

We may be unable to perform or may experience delays in performing certain obligations due to circumstances beyond our reasonable control.

Such circumstances may include natural disasters, extreme weather, government actions or restrictions, strikes, transportation disruptions, courier service interruptions, supplier problems, internet or telecommunications failures, technical outages, public emergencies, or other events that materially affect normal business operations.

Where such circumstances occur, applicable processing, delivery, communication, or service timelines may be affected.

13. Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the applicable laws of the Islamic Republic of Pakistan.

Subject to any mandatory consumer protection rights or other applicable legal requirements, disputes relating to these Terms or transactions with The Mobile Essential shall be subject to the jurisdiction of the competent courts in Karachi, Sindh, Pakistan.

14. Changes to These Terms

The Mobile Essential may update or modify these Terms of Service from time to time to reflect changes in our business, services, website, policies, or applicable requirements.

Updated Terms will be published on our website with a revised “Last Updated” date. Your continued use of the website or services after an update may constitute acceptance of the revised Terms to the extent permitted by applicable law.
